While we endeavor to keep the information up-to-date and correct, we make no representations or warranties of any kind, express or implied, about the completeness, accuracy, reliability, suitability or availability with respect to the website or the information, products or services contained on the website for any purpose. The service and content from or through this site are provided "As-Is" and "As Available" basis. TranzAct Technologies, Inc. does not warrant that StarRate or any of its systems or services will meet all of customer's requirements or that its operations will be uninterrupted, error or omissions free. Furthermore, no oral or written information, representation or advice given by TranzAct Technologies or an authorized representative of TranzAct Technologies, Inc. shall create a warranty. The owner of this site assumes no liability or responsibility for any errors or omissions in the content contained on this site.

User agrees to indemnify, defend and hold TranzAct Technologies, Inc., its Owners, affiliates, licensors, content and service providers, and suppliers harmless from any liability for any losses or damage including without limitation, indirect or consequential loss or damage, or any loss, damage or economic whatsoever arising out of, or in connection with, the use of this website or the services offered.

TranzAct Technologies, Inc. is not a freight carrier or an agent for a freight carrier. TranzAct Technologies, Inc. will not be responsible in any way for claims arising out of Customer negligence, carrier's negligence or the negligence of any third party. The filing of any claim does not relieve the responsible party for payment of freight charges. Freight payment is necessary in order to process a claim. Customer may not offset freight or other charges owed to TranzAct Technologies, Inc. against claims for any loss, damage, mis-delivery or non-delivery.

TranzAct Technologies, Inc. reserves the right to amend or adjust the original quoted amount if the original quoted amount was based upon incorrect information received at the time of the original quote, typographical or technology error, if additional services by the carrier were required, or as otherwise necessary to perform the pickup, transportation and delivery functions therein. Customer accepts full responsibility for a correct and accurate BOL. Customer agrees to pay for all services as actually provided and invoiced. Billing will be based on the actuality of the following: Actual commodity shipped, actual shipping weight including packing, crating and pallet, actual dimensions, actual volume, NMFC commodity code, actual freight class, number of items, type of service requested and other applicable accessorial charges, including, but not limited to all duties, customs assessments, governmental penalties and fines, taxes, and TranzAct Technologies, Inc.'s fees and charges allocable to the Shipment. The carrier reserves the right to inspect all shipments to determine discrepancies and assess applicable charges which you are solely responsible for payment.

The transit time displayed is intended to provide the user with an estimation of required service time between the origin and destination points provided under normal operating circumstances. Displayed transit times do not include day of pickup, weekend or local/national holidays. Transit times displayed are not guaranteed, unless guaranteed service is requested, and Customer completes the required documentation, communication and shipment meets all requirements as required by the carrier.

In no event will TranzAct Technologies, Inc. or Carrier be liable for any losses, lost profits, lost opportunity, economic damages, expense, or special, consequential or incidental damages Customer may have experienced as a consequence of transit times greater than expected or failure to meet the scheduled delivery date regardless of whether or not Carrier or TranzAct Technologies, Inc. knew or should have known that such damages might have been incurred.

In the event TranzAct Technologies, Inc. retains an attorney or collection agency to collect unpaid charges or for the enforcement of these Terms and Conditions, all unpaid charges will be subject to late payment penalties and the Customer shall also be liable for all Attorney and Collection agency fees incurred, together with related costs and expenses.

GUARANTEED SERVICE:

The General Rules Tariffs, set forth by the carriers, for guaranteed service will in every instance take precedence in all legal proceedings and when in conflict, will take precedence over these Terms and Conditions.

The transit time displayed is intended to provide the user with an estimation of required service time between the origin and destination points provided under normal operating circumstances. Displayed transit times do not include day of pickup, nor weekend or local/national holidays. The scheduled delivery date will be based on the date the pickup actually occurs and not on the date that the pickup was scheduled to occur.

However, there are exclusions and in these cases the money back guarantee is waived.

The following exclusions will disqualify a shipment from moving as a guaranteed shipment:

  1. Originating from, or destined to, any points not direct coverage area and / or outside the contiguous United States, including the states of Alaska and Hawaii and the common wealth of Puerto Rico, Guam, US Virgin Islands and other US territories; to or from Canada, Mexico, the Caribbean
  2. Containing poisonous materials
  3. Held for consolidation
  4. Volume / TL service (at or over 10,000 lbs.)
  5. Capacity Load or Cubic Capacity Shipments.
  6. Shipments with individual pieces that are 12 feet in length or greater in any direction.
  7. Involving Shipper or Consignee caused delay
  8. Shipments moving under Spot Quotes
  9. Shipments consigned to military installations
  10. Shipments subject to Limited Access Pick-up or Delivery.
  11. With scheduled delivery dates during designated blackout periods (December 21 through January 3)
  12. All shipments scheduled for delivery or in transit on the following designated holidays*: New Year's Day, Good Friday, Memorial Day, Independence Day, Labor Day, Thanksgiving Day, Friday after Thanksgiving Day, Christmas Eve, Christmas Day, or any other day generally observed as a holiday by the carrier at the point where the service is performed and/or no service days as defined by the individual carrier. Any holiday or no service days will add to the transit time.
  13. Requiring delivery on a weekend.
  14. Requiring delivery to residences (i.e., private residences, apartment complexes, dormitories, businesses located at a private residence, farm or ranch)
  15. Requiring special equipment for delivery (i.e.: lift-gate services, straight truck, unloading equipment, etc.)
  16. Requiring appointments and/or specific window time deliveries

q. Requiring pre-notification of delivery

  1. Requiring COD's
  2. Requiring Consignee unload
  3. Shipments that are dock pickup or will call
  4. Involving spotted trailers at origin or delivery
  5. Shipments requiring nose load/load to ride are non-compliant for on-time delivery

w. Shipments that are dock drops

  1. Delayed due to missing, incomplete or inaccurate documentation
  2. Requiring "protect from freeze" service
  3. Held for inspection or detained by governmental regulation or mandate
  4. Does not cover shipments delivered damaged or short/partial deliveries. Customer must utilize Carrier's OS&D claims process to file claims for damaged items or short/partial deliveries. Guarantee does cover the transportation charges associated with damaged items delivered beyond the scheduled delivery date, or short/partial deliveries if Carrier fails to deliver at least one item out of the shipment by the scheduled delivery date.
  5. If the failure to meet the scheduled delivery date is caused by events beyond Carrier's control, including, but not limited to, acts of God; acts or omissions of public authority; riots, strikes or labor disputes, including those of third parties; government regulations, orders or requirements; disruption in ground transportation as a result of weather or other causes; acts of public enemies or acts of terrorism; disruption or failure of communications or information systems; or acts or omissions of Shipper, Consignee or Owner of goods or any person or entity other than Carrier.

TranzAct Technologies, Inc. and/or Carrier reserves the right to modify, suspend or cancel money-back guaranteed service at its sole discretion at any time without prior notice.

Customer may request a refund of the transportation charges due to missed guaranteed service. In the event the shipment did not meet the requested service on the day of the scheduled delivery, the debtor must submit a written refund request to Carrier. To initiate a refund request for missed guaranteed service, the Customer must utilize and complete accurately and in full the Carrier's refund request process, including all required supporting documentation and submit to Carrier within ten (10) calendar days of the date of invoice. The Carrier will either credit or refund the guaranteed transportation charges for each such shipment, upon request, provided the conditions set forth in the service guarantee are met. Guaranteed transportation charges may not include other fees or charges that may be assessed by the Carrier including, but not limited to, fuel surcharges.
